Licensed Medical Providers; Scope of Practice

BondiPure Health employs and contracts with licensed medical providers, including physicians, nurse practitioners, registered nurses, and other allied health professionals who hold active, valid licenses and credentials in their respective local, state, national, and/or international jurisdictions. All licensed providers engaged by BondiPure Health are subject to a rigorous onboarding and credentialing verification process, which includes, but is not limited to, confirmation of active licensure, verification of education and training, review of disciplinary history, and ongoing compliance with applicable continuing-education requirements.

Notwithstanding the foregoing, any information, guidance, or services provided by BondiPure Health's licensed providers through the Site, by telephone, by video, or by any other medium is offered within the scope of practice permitted by the provider's licensure and the laws of the jurisdiction in which the provider is licensed. Such services are intended to supplement, not replace, the care provided by your primary physician or local healthcare provider. BondiPure Health does not guarantee that a licensed provider will be available in every jurisdiction or that services will satisfy the regulatory requirements of every jurisdiction in which a user may reside.

You acknowledge and agree that: (a) the credentialing and verification process employed by BondiPure Health is an internal quality-assurance measure and does not constitute a warranty or guarantee of any provider's competence, judgment, or suitability for your particular health needs; (b) licensure requirements, scope-of-practice limitations, and regulatory frameworks vary by jurisdiction, and it is your responsibility to determine whether the services offered are appropriate and lawful in your location; (c) no provider-patient, physician-patient, or analogous clinical relationship is established merely by your use of the Site, purchase of a product, or participation in any program unless explicitly agreed to in writing by both you and the provider; and (d) BondiPure Health, its officers, directors, employees, and affiliated providers shall not be liable for any adverse outcome, injury, or damages arising from your reliance on information or guidance provided through the Service, except to the extent such liability cannot be excluded or limited under applicable law.

Nothing in this section shall be construed to expand BondiPure Health's liability beyond the limitations set forth in the Limitation of Liability section of these Terms or to create any duty of care not otherwise imposed by applicable law.

Eligibility

You must be at least 18 years of age (or the age of legal majority in your jurisdiction) to purchase from or use the Service. By using the Service, you represent and warrant that you meet this requirement.

Coaching Programs; Telesales and Installment Plans

In addition to test kits, BondiPure Health offers a structured health coaching program, The Meridian Series (the BondiPure Clinic Gut Health & Cellular Renewal Program), currently offered in three tiers: Meridian Apex (Premium Tier), Meridian Summit (Mid Tier), and Meridian Rise (Entry Tier), each available in 3-month, 6-month, and 12-month plans. Program names, contents, and pricing may be updated from time to time; the plan you purchase is described at the point of sale.

If you purchase a fixed-term coaching program (for example, a 12-month plan) over the phone with a sales representative or through the Site, you agree to pay the total contract value. If you select a monthly payment plan, you authorize us to charge your payment method monthly for the duration of the agreed-upon term until the total purchase price is paid. These installment plans are not month-to-month subscriptions and cannot be canceled early to avoid the remaining balance, except as expressly permitted by law or our refund policy. If your payment method fails, we reserve the right to suspend your access to the program until the outstanding balance is paid. We may attempt to charge your payment method again, and you will be responsible for any fees, such as overdraft fees, charged by your bank.

Text Message & Phone Communications

We may text or call you as part of the Service or as part of a promotion ("Communications"). We do not charge for Communications, but message and data rates may apply from your carrier. By providing your telephone number, you authorize us to send recurring SMS/MMS messages and make calls to that number, and you represent that you are authorized to receive messages at that number. Consent to receive automated messages is not required as a condition of purchase. Message frequency varies. You can opt out at any time by replying STOP, END, CANCEL, UNSUBSCRIBE, or QUIT to any message; altered or modified opt-out phrasing may not be recognized. Delivery of mobile messages is subject to your carrier and outside our control, and we are not liable for failed, delayed, or undelivered messages.

We do not claim, and you should not assume, that the experiences of individuals providing testimonials are typical. Results vary significantly based on individual effort, health factors, and other circumstances.

Limitation of Liability

Under no circumstances, including negligence, shall we, our subsidiary and parent companies, or affiliates be liable for any direct, indirect, incidental, special, or consequential damages that result from the use of, or the inability to use, the Site, including our messaging, emails, products, or services, even if we are advised beforehand of the possibility of such damages. If you are dissatisfied with the Site, any materials, products, or services on the Site, or with any of the Site's terms and conditions, your sole and exclusive remedy is to discontinue using the Site.

Cap on liability: to the fullest extent permitted by law, we will not be liable to you for more than the greater of (a) the total amount paid to us by you during the twelve-month period prior to the act, omission, or occurrence giving rise to such liability; (b) $100; or (c) the statutory damages prescribed by a statute under which such claim arises. Multiple claims will not expand this limitation. The limitations of damages set forth above are fundamental elements of the basis of the bargain between you and us.

Statute of limitations: to the fullest extent permitted by law, no claim, demand for mediation or arbitration, or cause of action which arose out of an event that occurred more than two (2) years prior to the filing of a demand for arbitration or suit may be asserted by you against us.

Indemnification

You agree to indemnify and hold us harmless for any of the following: (a) your use of the Service; (b) any content you provide; (c) your violation of our policies; (d) your violation of any rights of another party; and (e) your violation of any applicable law. These provisions survive any termination of your account and any changes to our policies or Service.

Feedback

If you share comments, ideas, or feedback with us, we have the right to use it in any manner, including in future enhancements and modifications to our products and services. All such feedback shall be owned exclusively by us, and you agree to assign all right, title, and interest in and to such feedback and related intellectual property.

Refund Policy

Your purchase of a product or service may or may not provide for a refund. Each specific product will specify its own refund policy. The FIT22 and FIT176 gut tests are single-use diagnostic kits. Once a kit has been opened, used, or the sample has been collected and submitted to the lab, the kit is consumed and cannot be returned, exchanged, or refunded under any circumstances. For any test kit that gets mailed out but remains sealed and unused, there is a $50 restocking fee that comes from the lab; refunds minus the $50 are issued only upon successful receipt of the unopened, unused returned kit by the lab. There are no refunds on kits that are opened, used, tampered with, or submitted. Any other hard goods have a 25% restocking fee for unopened items. Opened items or supplements are not eligible for refunds. There are no refunds on The Meridian Series coaching tiers, including Meridian Apex, Meridian Summit, and Meridian Rise and their respective 3-, 6-, and 12-month plans, except as expressly required by law or as stated at the point of sale.

Termination; Survival

We may cancel or terminate your right to use the Site or any part of the Site at any time without notice. In the event of cancellation or termination, you are no longer authorized to access the affected part of the Site. The restrictions imposed on you with respect to material downloaded from the Site, and the disclaimers, limitations of liability, indemnification, dispute-resolution, and arbitration provisions set forth in these Terms, shall survive termination.

Dispute Resolution; Binding Arbitration

These Terms shall be governed by and construed in accordance with the laws of the State of Delaware. Any dispute, claim, or disagreement arising out of or relating to the Service or your relationship with us will be resolved by binding individual arbitration, except that either party may bring qualifying individual claims in small-claims court. This arbitration agreement extends to claims you may have against our business partners, vendors, payment processors, and other third parties involved in providing the Service, who are intended third-party beneficiaries of this provision.

Informal dispute resolution first. Before filing an arbitration, you agree to try in good faith to resolve any dispute informally. You must send an individualized written notice of dispute to [email protected] that includes (1) your name, phone number, and email address, and (2) a description of the dispute and how you'd like it resolved. Once a complete notice has been received, the recipient has 60 days to investigate and try to resolve the claims, and either side may request a settlement conference by phone or video during that period, in which you and we will each personally participate. An arbitration cannot be filed until this informal period has ended, and a court can enjoin the filing or prosecution of an arbitration in breach of this section. Any statute of limitations will be tolled during the informal dispute-resolution period.

Mass filings. If 25 or more similar demands for arbitration are asserted against us by the same or coordinated counsel, the demands will be administered in batches under the arbitration provider's mass-claims protocol then in effect.

Opt-out. You may opt out of this arbitration agreement within 30 days after you first accept these Terms by sending written notice of your decision to [email protected], including your name and the email address associated with your purchase. If you opt out, neither we nor you will be required to arbitrate, but the remainder of these Terms will otherwise apply to you.

If any provision of this agreement shall be unlawful, void, or unenforceable, that provision shall be deemed severable and shall not affect the validity and enforceability of any remaining provisions.

Class Action Waiver; Jury Trial Waiver

You and we each agree that any proceeding, whether in arbitration or in court, will be conducted only on an individual basis and not in a class, collective, consolidated, private attorney general, or representative action. Any dispute over the enforceability of this waiver will be decided by a court of competent jurisdiction, not an arbitrator. If this waiver is found to be unenforceable, the class or representative claim must be brought in court, while any remaining individual claims shall be arbitrated. To the fullest extent permitted by law, you and we waive any right to a jury trial.

Third-Party Payment & Fulfillment Providers

We use third-party service providers to process payment for the Service (card acceptance, merchant settlement, and related services). By using the Service, you authorize us to share the information and payment instructions you provide with our payment service providers to the extent necessary to complete your transactions. Physical products may be manufactured, fulfilled, and shipped by third-party partners; shipping times and product handling for such goods are subject to the respective partner's policies.
